terms of service

Please refer to the Terms of Service below for my terms, which WILL apply to your orders. By reading this and agreeing to commission me, you agree to the following terms.

PAYMENTS
1. By commissioning me, you agree to pay the full amount upfront before I begin.
2. Payment is via Venmo, PayPal, Chime, Vgen, Artistree, or Ko-fi. I will send an invoice if we are using PayPal, Venmo, or Chime. You can order straight from Ko-fi, Artistree and Vgen!PRODUCT DELIVERY
3. You agree that the product will be delivered digitally to the email address you provide after I have finished the work and received approval for the finished work.
4. Any other method of delivery, either digital or physical, must be mutually agreed upon before the work commences. You are obliged to bear any costs incurred by an alternative delivery method, such as postal costs, material costs, digital service subscription fees, etc.
5. It is your sole responsibility to propose a delivery method that works for both parties. I cannot be held accountable for your loss of access to the delivery method, loss of delivered files, impediments such as spam filters, or any other technical obstacles outside the Seller's responsibility.
5b. Upon delivery of the product, it is your responsibility to store it properly. Loss of the product due to negligence will not be reimbursed by me. I cannot guarantee that the original copy of the product will be available if you lose your files.REVISIONS
6. You have the right to three complete revisions in the sketching phase.
7. You have the right to a reasonable amount of minor edits after completion, such as changing eye color or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered product. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase in order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until payment for the additional invoice(s) has been received.CURRENCY CONVERSIONS
8. You agree to pay the total amount specified in USD.
9. It is your sole responsibility to bear any currency conversion costs, bank transfer fees, payment provider service fees, and any other costs involved in transferring funds to the Seller.
10. Payment is considered received and completed only when the total amount received in the Seller's USD account is equal to the invoice amount in USD.REFUND POLICY
12. You have the right to request a full refund if there has been no progress for two consecutive months, or when the product has not been completed. Refund conditions for commissions that require more work must be agreed upon separately before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident, or any other credibly documented reason for interruption of work.
13. You are obligated to contact me in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc. A lack of timely communication on your behalf will be recognized as implicit approval of all work progress and the current state of the product.
14. If for any reason you need to cancel your commission after paying and before I finish the sketch (which usually takes me a few days), I can give a partial refund (I will keep a minimum of 25% of the total cost).
15. In the rare event I feel that I cannot complete the commission at all, I can give a partial refund depending on how much I have completed. (I will keep 25% of the total cost minimum).
16. Please be kind. Any aggressive, rude, or inappropriate behavior against me during the process will result in me canceling the commission. You will be refunded for the commission upon cancellation by me, but I will be keeping 50% of the total payment.PERSONAL AND COMMERCIAL USE
17. The product received is for personal use. Any use of the product for commercial purposes, reselling it, reproduction, or publishing for reasons other than personal purposes must be approved beforehand by me. This will require a separate agreement between us defining the exact conditions and financial implications of such use of the product.
18. You do not have the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in that space.
19. In addition, you do not have the right to use the product for AI datasets or for AI tools and any present or future inventions in that space.
